End User Licence Agreement

1. Ownership

This application ("the App") is owned and operated by SymbioTeK Pty Ltd, a company registered in Australia (ACN 694 230 334). All intellectual property rights in the App remain with SymbioTeK Pty Ltd.

2. Licence & Credits

SymbioTeK Pty Ltd grants you a non-exclusive, non-transferable, revocable licence to use the App. New users receive 3 free AI-powered sign captures (using the Opus model). Additional AI detection credits are purchased in batches via the Pricing tab, with two models available: Sonnet (for well-maintained sites) and Opus (for faded or damaged signage). Credits are non-refundable and do not expire. SymbioTeK Pty Ltd reserves the right to adjust pricing, terminate, or restrict access at any time, without prior notice and at its sole discretion.

3. Payments & Refunds

All payments are processed securely by Stripe in Australian Dollars (AUD). Prices are inclusive of GST. Credit purchases are one-off payments — there are no subscriptions or recurring charges. Credits are non-refundable once purchased, as they are digital goods consumed on use. In exceptional circumstances, refund requests may be considered at SymbioTeK's sole discretion by contacting symbiotek@symbio-tek.com. If a refund is approved, Stripe's non-refundable processing fees (currently 1.7% + A$0.30 per transaction) will be deducted from the refund amount. Refunds typically take 5–10 business days to appear on your statement. For full payment terms, refer to Stripe's Terms of Service.

4. AI-Powered Detection

The App provides AI-powered sign detection using Anthropic's Claude Vision API, proxied through SymbioTeK's server infrastructure. Each AI detection consumes one credit from your purchased batch (Sonnet or Opus). When no credits are available, the App falls back to local computer vision (lower accuracy, no credits required, works offline). SymbioTeK Pty Ltd is not liable for the accuracy of AI or local detection results.

5. Data & Sub-processors

All audit data — including photographs, GPS coordinates, site/client names, and compliance records — is stored locally on your device (in your browser's IndexedDB). The following sub-processors receive specific data when you use specific features:

  • Anthropic, PBC (United States) — when you use AI detection, the captured sign photograph is transmitted via SymbioTeK's server-side proxy to Anthropic's Claude Vision API for analysis. GPS coordinates, site names, client names, auditor names, and notes are NOT transmitted; only the sign image. SymbioTeK does not store the image, and Anthropic's data handling is governed by their Privacy Policy. Photos may incidentally include faces, vehicle plates, or facility details visible in frame — review images before capture in sensitive environments.
  • Supabase, Inc. — database hosted in AWS Singapore (ap-southeast-1); edge function compute in AWS Sydney (ap-southeast-2). Handles your account email, hashed password, credit balance, and an immutable purchase/usage transaction log. No audit data is stored — your photographs, GPS coordinates, site names, client names, auditor names and compliance findings stay on your device unless you manually export a backup.
  • Stripe Payments Australia Pty Ltd — processes credit purchases. Card details never reach SymbioTeK or Anthropic.
  • Netlify, Inc. — serves the static web app and proxies no audit data.

Backups exported via Settings → Backup & Restore contain photos and GPS coordinates in a JSON file you control. If you save that file to a third-party cloud (iCloud, Drive, Dropbox), that provider becomes a custodian. Backups can optionally be passphrase-encrypted before export.

SymbioTeK Pty Ltd does not access or store your audit data.

6. Disclaimer

The App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. The App is intended as a field auditing aid only and is not a substitute for professional compliance assessment by a qualified person. Users should verify all compliance findings independently against AS 1319-1994 and any applicable legislation. AI detection results are indicative only and must be reviewed by the auditor.

7. Limitation of Liability

To the maximum extent permitted by law, SymbioTeK Pty Ltd shall not be liable for any loss, damage, or injury arising from the use of, or reliance on, the App or its output. This includes, without limitation, any decisions made based on compliance assessments generated by the App or its AI detection features.

8. Governing Law

This agreement is governed by and construed in accordance with the laws of Australia. Any disputes arising under this agreement shall be subject to the exclusive jurisdiction of the courts of Australia.
